Terms of Service

Please read these Terms of Service carefully before using the mycache platform. These Terms form a legally binding agreement between you and mycache Pty Ltd.
1. Agreement
By accessing or using the mycache platform, website, or any related services (collectively, "the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Platform on behalf of a business, you represent that you have authority to bind that business to these Terms.
If you do not agree to these Terms, you must not use the Platform.

2. The Platform
mycache provides a white-label membership and loyalty software platform that enables businesses ("Operators") to offer prepaid digital wallets, tiered loyalty rewards, and recurring membership subscriptions to their clients ("Members").
The Platform includes:
- A branded web application for Members to manage their wallet, pass, and membership
- A staff redemption screen for Operators to verify and process wallet draws
- Apple Wallet and Google Wallet pass integration for live balance display
- Stripe-powered payment processing for top-ups and membership billing
- Reporting and reconciliation tools for Operators
3. Accounts and eligibility
To use the Platform as an Operator, you must:
- Be at least 18 years old
- Be a legally registered business in Australia (or your applicable jurisdiction)
- Provide accurate and complete business information during onboarding
- Maintain a valid Stripe account connected to your mycache account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@mycache.com.au if you suspect unauthorised access.
4. Fees and payment
Setup fee: A one-time setup fee is charged upon commencement of your account configuration. This fee covers white-label configuration, brand application, Stripe integration, and onboarding support. Setup fees are non-refundable once configuration work has begun.
Monthly platform fee: A recurring monthly fee is charged for ongoing access to the Platform. Monthly fees are billed in advance. Fees are in Australian Dollars (AUD) unless otherwise agreed.
Transaction fee: A percentage-based fee is applied to wallet top-up activity processed through the Platform. This fee is in addition to any Stripe processing fees.
Fee changes: We reserve the right to update our fees with 30 days' written notice. Continued use of the Platform after the effective date of a fee change constitutes acceptance of the new fees.
All payments are processed via Stripe. By using the Platform, you also agree to Stripe's Terms of Service.
5. Wallet funds and Stripe
All client wallet funds are processed and held within your own connected Stripe account. mycache does not hold, custody, or control client funds on your behalf.
You are responsible for:
- Ensuring your Stripe account remains active, verified, and in good standing
- Compliance with Stripe's terms regarding money transmission and prohibited businesses
- Accurately representing your business to Stripe during account setup
- Any chargebacks, disputes, or refund obligations arising from your use of Stripe
mycache is not liable for any losses arising from Stripe account suspensions, holds, or terminations.
6. Operator responsibilities
As an Operator, you agree to:
- Accurately represent the terms of your loyalty and membership program to your Members
- Honour wallet balances and redeem credits as represented to Members
- Not use the Platform for any unlawful purpose or in violation of any applicable law
- Not attempt to reverse-engineer, copy, or build competing products using the Platform
- Maintain appropriate records of Member data as required by Australian law
- Promptly notify us if you become aware of any security issue or data breach
You are responsible for your own compliance with consumer protection laws, including the Australian Consumer Law, in your dealings with Members.
7. Intellectual property
The Platform, including all software, design, branding, and content developed by mycache, is owned by mycache Pty Ltd and protected by Australian and international intellectual property laws.
Your use of the Platform does not grant you any ownership rights in mycache's intellectual property. You may not copy, modify, distribute, or create derivative works from the Platform without our prior written consent.
Any feedback, suggestions, or improvements you provide to us may be used by mycache without restriction or compensation to you.
8. Limitation of liability
To the maximum extent permitted by law, mycache's total liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the total fees paid by you to mycache in the three months preceding the claim.
mycache is not liable for:
- Indirect, incidental, consequential, or punitive damages
- Loss of profit, revenue, data, or business opportunity
- Interruptions to the Platform or third-party service outages (including Stripe, Apple, or Google)
- Actions or omissions of third parties
Nothing in these Terms excludes, restricts, or modifies rights under the Australian Consumer Law that cannot be excluded.
9. Suspension and termination
Either party may terminate these Terms with 30 days' written notice. mycache may suspend or terminate your access immediately if:
- You breach any material term of these Terms
- Your Stripe account is suspended or terminated
- We are required to do so by law or a regulatory authority
- You engage in any activity that may harm mycache, other users, or third parties
Upon termination, your access to the Platform will cease. Outstanding fees remain payable. Member wallet balances remain in your Stripe account — you are responsible for honouring outstanding balances.
10. Dispute resolution
If a dispute arises between you and mycache, the parties agree to first attempt to resolve the dispute informally by contacting hello@mycache.com.au.
If the dispute cannot be resolved informally within 30 days, either party may refer the matter to mediation administered by a recognised Australian mediation provider.
Nothing in this clause prevents either party from seeking urgent injunctive or equitable relief from a court.
11. Governing law
These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland for the resolution of any dispute.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date and notify you by email where the changes are material. Continued use of the Platform after the effective date of any changes constitutes acceptance of the revised Terms.
